NOTICE OF SALE UNDER POWER CONTAINED IN SECURITY DEED STATE OF GEORGIA COUNTY OF LOWNDES Pursuant to a power of sale contained in a certain security deed executed by Roy Register hereinafter referred to as Grantor, to Raymond McLeod and Dorothy McLeod, as recorded in Deed Book 5908, beginning at Page 062, of the deed records of the Clerk of the Superior Court of the aforesaid state and county, and by virtue of a default under the terms of said security deed, and the related note, the undersigned attorney-in-fact for the aforesaid Grantor (which attorney-in-fact is the present holder of said security deed and note secured thereby) will sell at the usual place of conducting Sheriffs sales in said county within the legal hours of sale, to the highest bidder on the first Tuesday in May, 2024, all property described in said security deed including but not limited to the following described property: All that tract or parcel of land situate, lying and being in Land Lot 72 of the 15th Land District of Lowndes County, Georgia, and being all of Lot 6, Block D, County Estates East, Section I, as depicted upon a map or plat of survey dated August 13th, 1979, prepared by Fitzsimons & Associates, Surveyor, recorded in Plat Record Book C, Page 184, Lowndes County, Georgia deed records, to which map or plat of survey and the record thereof reference is hereby made for all purposes in aid of description. All that tract or parcel of land situated, lying and being in Land Lot 72 of the 15th Land District of Lowndes County, Georgia and being further described as follows: As a point of reference only begin at the southwest projected Right of Way margin intersection of Dove Drive (60 R/W) and Will-O-Wisp Drive (60 R/W); thence proceed S 01 degrees 41 minutes 09 seconds W a distance of 22.49 to a point; thence proceed along a curve in the western R/W margin of Will-O-Wisp Drive having a radius of 360.80, an arc of 160.59, a chord bearing of S 11 degrees 03 minutes 56 seconds E and a chord distance of 159.27 to a point, thence continuing along said R/W margin proceed S 23 degrees 49 minutes 01 seconds E a distance of 34.74 to a point; thence continuing along said R/W margin proceed along a curve having a radius of 318.44 an arc of 43.66, a chord bearing of S 19 degrees 53 minutes 24 seconds E and a chord distance of 43.62 to a point; thence leaving said R/W margin proceed N 86 degrees 14 minutes 47 seconds W a distance of 116.58 to a point; thence proceed N 04 degrees 01 minutes 18 seconds E a distance of 62.84 to a point; thence proceed N 88 degrees 17 minutes 33 seconds E a distance of 83.08 to a po int and the POINT OF BEGINNING. Said tract contains 6795.2798 square feet (0.1560 acres). Said property will be sold on an as-is basis without any representation, warranty, or recourse against the above-named or the undersigned. The sale will be subject to the following items which may affect the title: any outstanding ad valorem taxes (including taxes which are a lien but not yet due and payable); any matters which might be disclosed by an accurate survey and inspection of the property; any assessments, liens, encumbrances, zoning ordinances, restrictions, and all other matters of record superior to the said Security Deed. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
